TERMS AND CONDITIONS - DISSERTATION AND THESIS EDITING SERVICES - Update 1/2/2024
1. INTRODUCTION
1.1 These Terms and Conditions ("Agreement") govern the provision of dissertation and thesis editing services ("Services") by Dr. Edward Marchewka, hereinafter referred to as the "Editor," to the client ("Client"). The Services encompass comprehensive editing assistance for the Client's thesis or dissertation.
2. SCOPE OF SERVICES
2.1 The Services include, but are not limited to, the following:
3. TURNAROUND TIME
3.1 The average turnaround time for the completion of the Services is 4 days (96 hours), subject to variation based on paper length and the extent of required editing.
3.2 An expedited turnaround time option is available for an additional fee. Clients interested in expedited services should contact the Editor to discuss the availability, pricing, and terms associated with this option.
4. CLIENT OBLIGATIONS
4.1 The Client agrees not to use the Services for any unethical or illegal purposes, including but not limited to plagiarism or academic dishonesty.
4.2 The Client is responsible for providing accurate and complete information necessary for the editing process.
5. LIMITATIONS OF SERVICES
5.1 The Editor's role is limited to providing editing and guidance services. The Editor will not write the paper on behalf of the Client.
6. PAYMENT TERMS
6.1 The Client agrees to pay the agreed-upon fee for the Services as per the pricing structure provided by the Editor.
6.2 Payment is due upon acceptance of the editing service request.
7. CONFIDENTIALITY
7.1 The Editor agrees to keep all information provided by the Client confidential.
8. GOVERNING LAW AND JURISDICTION
8.1 This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois, and any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located within Kane County, Illinois.
8.2 The parties hereby consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
By engaging in the Services, the Client acknowledges and agrees that any legal proceedings arising out of or related to this Agreement shall be conducted in the state and federal courts within Kane County, Illinois.
9. DISPUTE RESOLUTION
9.1 Any disputes arising out of or in connection with this Agreement shall be resolved through arbitration in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
10. AMENDMENTS
10.1 This Agreement may be amended only in writing and signed by both parties.
By engaging in the Services, the Client acknowledges and agrees to be bound by these Terms and Conditions.
11. REFUND POLICY
11.1 Refunds for the Services will be considered on a case-by-case basis. Clients seeking a refund should contact the Editor within 7 days of receiving the edited document. Refunds will be granted solely at the discretion of the Editor.
11.2 The Services are provided "as is." The Editor makes no warranties, express or implied, regarding the Services, including but not limited to, the accuracy, completeness, or suitability for a particular purpose.
12. LIMITATION OF LIABILITY
12.1 The liability of the Editor under this Agreement shall be limited to the total fees paid by the Client for the Services.
12.2 In no event shall the Editor be liable for any consequential, incidental, indirect, special, or punitive damages, including but not limited to loss of profits or data, arising out of or in connection with the use or inability to use the Services.
12.3 The Editor shall not be responsible for any term extensions, academic consequences, or failure to meet specific university requirements. It is the Client's responsibility to ensure that the edited document complies with their institution's guidelines and standards.
By engaging in the Services, the Client acknowledges and agrees to be bound by these additional clauses related to refunds and limitations of liability.
13. AMENDMENTS AND UPDATES
13.1 These Terms and Conditions may be updated or amended by the Editor from time to time.
13.2 The Client will be notified of any changes to these terms via the email address provided during the engagement of Services.
13.3 Continued use of the Services after the effective date of any amendments constitutes acceptance of the revised Terms and Conditions.
By engaging in the Services, the Client acknowledges and agrees that these Terms and Conditions may be updated periodically, and it is the Client's responsibility to review them for any changes.
14. SUBSCRIPTION SERVICE LIMITATIONS
14.1 For Clients subscribing to recurring Services, a monthly limit of four (4) submissions per month is applicable under the subscription plan.
14.2 Any additional submissions beyond the monthly limit may be subject to additional charges at the discretion of the editor.
14.3 The monthly submission count resets at the beginning of each month.
By engaging in the subscription Services, the Client acknowledges and agrees to abide by the specified submission limitations outlined in this section.
15. SEVERABILITY
15.1 If any provision of this Agreement is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be deemed severed from this Agreement, and the remaining provisions shall remain in full force and effect.
15.2 The parties agree to replace any invalid or unenforceable provision with a valid and enforceable provision that most closely aligns with the original intent of the Agreement.
By engaging in the Services, the Client acknowledges and agrees that the enforceability of one section does not affect the enforceability of the remaining provisions of this Agreement.
